Terms of Service

These Terms of Service ("Terms") govern your access to and use of the FetchBox website, application, and related services (collectively, the "Services"). The Services are owned and operated by Hints LLC d/b/a FetchBox (thefetchbox.com) ("FetchBox," "we," "us," or "our").

By using the Services, placing an order, or clicking to accept these Terms, you agree to be bound by them. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to use the Services. If you are using the Services on behalf of a company or other organization, you represent that you have authority to bind that entity to these Terms.

2. Our Services

FetchBox provides a retail device-return service designed to help customers retrieve laptops and similar equipment from a recipient at another location.

As part of the Services, FetchBox may provide some or all of the following:

• an empty box or shipping kit;
• packing materials;
• printed instructions;
• a prepaid return label;
• order and shipment tracking information; and
• related customer support.

FetchBox is a starter / retail service only. FetchBox does not provide warehouse storage, inventory management, deployment services, IT asset disposition, or data destruction services unless expressly stated in writing.

3. Orders

When you place an order, you agree to provide accurate and complete information, including recipient details, shipping addresses, and billing information.

All orders are subject to acceptance and availability. We may reject, cancel, or limit any order at our discretion, including in cases of suspected fraud, pricing errors, carrier limitations, or service unavailability.

You are responsible for reviewing your order carefully before submitting it.

4. Pricing; Shipping; Payment

Prices for the Services are shown at checkout and may include or exclude taxes, shipping charges, carrier surcharges, and other fees as stated at the time of purchase.

By placing an order, you authorize FetchBox and its payment processor to charge your selected payment method for all amounts due, including applicable taxes, shipping fees, and related charges.

If your payment method is declined, invalid, or cannot be processed, we may suspend or cancel your order.

We may update our pricing at any time, but price changes will not affect orders already accepted.

5. Address Accuracy and Delivery Information

You are responsible for providing accurate delivery and recipient information.

FetchBox may use third-party tools to validate addresses, but you remain responsible for confirming that the information submitted is correct. We are not responsible for failed deliveries, delays, extra charges, or losses caused by inaccurate or incomplete address information provided by you.

6. Carrier Services and Third Parties

FetchBox relies on third-party carriers, shipping providers, payment processors, and other service providers to perform portions of the Services.

We are not responsible for the acts, omissions, delays, service failures, or decisions of third-party providers, including but not limited to shipping carriers and payment processors.

Your use of any third-party service may also be subject to that provider's own terms and policies.

7. Customer Responsibilities

You agree that you are responsible for:

• providing accurate order, billing, and shipping information;
• obtaining any necessary permission to send a kit to the recipient;
• ensuring the recipient follows the packing and return instructions;
• ensuring the returned item is lawfully owned or controlled by you or your organization; and
• complying with all applicable laws.

You agree not to use the Services for any unlawful, fraudulent, abusive, or misleading purpose.

8. No Guarantee of Return

FetchBox helps facilitate the retrieval process, but we do not guarantee that any recipient will return a laptop, charger, accessory, or other property.

Our service is fulfilled once we have processed the order and initiated shipment of the retrieval kit. We are not responsible if the recipient refuses, delays, or fails to return the item.

9. Risk of Loss; Packaging; Returned Items

You understand and agree that returned devices and other property may be lost, stolen, delayed, damaged, or improperly packed while in transit or while handled by third-party carriers.

FetchBox does not take title to, possession of, or responsibility for your property beyond arranging the retrieval workflow described in the Services.

Unless otherwise expressly stated in writing, you assume the risk of loss for any item sent through the Services, including loss or damage caused by:

• shipping carrier delays or mishandling;
• theft or loss in transit;
• improper packing by the recipient;
• incorrect shipping information provided by you; or
• events outside our reasonable control.

10. No Data Services

FetchBox does not inspect, wipe, erase, destroy, secure, recover, transfer, or back up any data on any laptop or device.

You are solely responsible for all data, software, files, and information stored on any device involved in the Services. FetchBox will not be liable for any data loss, data exposure, privacy incident, or security issue relating to any device.

11. Refunds and Cancellations

Orders may only be canceled before fulfillment begins, and any refund is subject to our refund policy and any non-recoverable costs already incurred.

Once an order has been processed, shipped, or handed off for fulfillment, it may be non-refundable.

If a pricing or processing error occurs, we may cancel the order and issue an appropriate refund, or correct the error and give you the option to proceed.

12. Account and Site Use

If we offer user accounts, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You may not:

• interfere with or disrupt the Services;
• attempt to access systems or data you are not authorized to access;
• copy, reverse engineer, or misuse the Services; or
• use the Services in violation of law.

We may suspend or terminate access to the Services at any time if we believe you have violated these Terms or created risk for us or others.

13. Intellectual Property

The Services, including the FetchBox name, branding, website, software, design, text, graphics, and related content, are owned by Hints LLC or its licensors and are protected by applicable intellectual property laws.

Except for the limited right to use the Services in accordance with these Terms, no rights are granted to you.

Your use of the Services is also subject to our Privacy Policy.

You agree to defend, indemnify, and hold harmless Hints LLC, FetchBox, and their officers, managers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to:

• your use of the Services;
• your violation of these Terms;
• your violation of law;
• your submitted information, content, or instructions; or
• any dispute between you and a recipient or third party relating to a retrieval order.

18. Changes to the Services or Terms

We may modify or discontinue all or part of the Services at any time.

We may also update these Terms from time to time. If we do, we will post the updated version and revise the Effective Date above. Your continued use of the Services after the updated Terms become effective constitutes your acceptance of the revised Terms.

19. Termination

You may stop using the Services at any time.

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms, created risk for us, or used the Services unlawfully.

20. Governing Law; Disputes

These Terms are governed by the laws of the applicable state, without regard to conflict of laws principles.

Any dispute arising out of or relating to these Terms or the Services shall be brought exclusively in the appropriate state or federal courts, and you consent to that jurisdiction and venue.

21. General

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

Our failure to enforce any provision of these Terms is not a waiver of that provision.

These Terms, together with any posted policies expressly incorporated by reference, are the entire agreement between you and FetchBox regarding the Services.
